What was the Capital Health Data Breach settlement about?

The lawsuit was filed against Capital Health Systems Inc. related to the data breach that happened between 11 November and 26 November 2023. The plaintiffs allege that the data breach has caused unauthorized access to the private information of the class members. 

The private information involves Social Security number, address, DOB, email address, medical information, and other sensitive information stored in the defendant’s technology systems. The plaintiffs filed a lawsuit against the defendant on 24 May 2025, saying the negligence of the defendant had led to such leakage of the data.

The lawsuit claims the defendant violated the New Jersey Consumer Fraud Act; the defendant denies the allegations. They have agreed to resolve the lawsuit and settle it with money. The preliminary approval was granted, and the claim process has begun with a deadline of 06 April 2026.

What will be the payout of the Capital Health data breach settlement?

From the Capital Health $4.5 million settlement, the valid claimants can have the following benefits:

  • Cash Benefit: If you have documented the loss you have incurred due to the Capital Health data breach, such as expenses to stop identity theft, or others, you can receive the cash payment of up to $5000.
  • Alternative Cash Payment: If you do not qualify for the documented loss or fail to provide the documents, you can go for the alternative cash payment. The settlement offers a $100 alternative cash payment to the eligible class members without any documentation. 
  • Credit Monitoring: Along with the cash payments, the settlement also offers the valid claimants a three years of credit monitoring service to the valid claimants, which is valued at $90 per year.

The settlement administrator has estimated the payments for the class members. If the net settlement fund is not enough or the amount of the claim form is higher, the payment can be reduced. The net settlement fund will be determined when the fund of $4.5 million is deducted for administration expenses, legal fees, and others.

  • Click the “Submit a Claim” option, read the instructions, and enter the Unique ID and PIN received with the settlement notice. 
  • Once you are logged in, you will get access to the claim form.
  • Now, enter all the valid details in the claim form and revise it before submitting it.

When can you expect the Capital Health data breach settlement payout?

The Capital Health data breach settlement still requires final approval from the federal court. The final hearing is scheduled on 14 July 2026, so until the court grants the final approval, the claimants have to wait for the payout.
