Must-haves:

  • Colorado residency: You must have been a resident of Colorado for the entire tax year 2023 (January 1st – December 31st).
  • Age: You must be at least 18 years old at the beginning of the tax year (January 1st, 2023).
  • No incarceration: You cannot have been incarcerated or committed to the Department of Human Services for 180 days or more during the state fiscal year (July 1, 2022 – June 30, 2023).
  • Income tax payment not required: You don’t necessarily need to have paid any state income tax in Colorado to be eligible for the TABOR refund.
  • No residency requirement for filing: While residency for the entire tax year is required for eligibility, you can still file a Colorado Individual Income Tax Return (DR 0104) to claim the refund even if you haven’t resided in Colorado for the entire year. 
  • However, in such cases, you won’t be eligible for the TABOR refund but might be eligible for other income tax credits or refunds.

Alternative option:

  • PTC Rebate Application: If you are a homeowner or renter with specific income qualifications, you can file a Property Tax/Rent/Heat (PTC) Rebate Application by April 15, 2024, instead of filing a complete income tax return. 
  • This application allows you to claim the TABOR refund without filing an income tax return.

Claiming the 2024 TABOR Refund 

When the time comes to claim the 2023 TABOR refund, here are the two main options:

Filing a Colorado Individual Income Tax Return (DR 0104):

  • This is the standard method for claiming the TABOR refund, even if you don’t owe any state income tax.
  • No online filing available: As of now, there is no online option to file the DR 0104 form. You can download the form from the Colorado Department of Revenue (CDOR) website or obtain a paper copy by mail.
  • Filing deadline: The deadline to file for the 2025 TABOR refund will likely be April 15, 2024.

Property Tax/Rent/Heat (PTC) Rebate Application:

  • This option is available for homeowners and renters who meet specific income qualifications.
  • Potential online filing in the future: The CDOR is currently exploring the possibility of offering an online filing option for the PTC Rebate Application in the future. However, this option is not yet available for the 2024 TABOR refund.
  • Deadline: The deadline to file the PTC Rebate Application for the 2025 TABOR refund will likely also be April 15, 2024.

  1. I am confused. My wife and I have filed state income tax paperwork and according to Turbo tax the submission has been accepted. We meet all eligibility requirements for Tabor refund. Do we need to submit any other forms? Will we receive the $1600 refund? Do you know when?
