The TreeHouse Foods has agreed for the settlement of the $4 million, you can get a portion from this settlement if you are among the class members. Individuals who bought the frozen waffles, which were later recalled because of listeria containment are eligible to get the payout from this settlement.
Note that the settlement resulted from a class action lawsuit, which was filed by the plaintiff Rugg-Harrell with allegations that the defendant TreeHouse Foods sold frozen waffles contaminated with listeria and failed to warn the public in time, because of which consumers face financial harm.
The settlement has already received a preliminary approval from the court, and now the class members can file a claim form through the webportal or via mailing to get the payout from this settlement. The due date for the same is disclosed publicly on the portal, it is December 16, 2025.

In order to file a claim form to get the payout from this settlement, it is mandatory that you meet the following conditions.

- You bought any frozen waffle between October 18, 2024 – September 2, 2025.

Per-Person Payout
There is no fixed per-person payout under this settlement, the amount you can get totally dependent on your claim form. If you file it with purchase proof, you will get the full amount you have spended; but in case of not having any proof, you can get a payout of two boxes of frozen waffles.
Note that in case if no purchase proof, a household can claim payout upto two boxes. As each box usually costs up to $5, you can expect the payment up to $10. If you have already received a recall refund, in this case you won’t get any payout.

Payout Date
The payment for this settlement will come after the final approval. The hearing for the same will take place on December 12, 2025. If the court approves the settlement without any appeal on this date, there is a high speculation that payment will come by April 2026.
