On August 9, 2022, the Court approved the Settlement finalistically. The Eleventh Circuit Court of Appeals refused an appeal of its October 25, 2023 ruling endorsing ratification of the Settlement Agreement on January 26, 2024. An appeal caused the BCBS Settlement Payout Date to be delayed; ultimately, in June 2024 the USSC settled the matter.

The Eleventh Circuit Court of Appeals ruling upholding approval of the Settlement Agreement was refused an appeal by the US Supreme Court on June 24, 2024. Every appeal is approved. Emails on claim decision notifications are sent rolling forward. 

BCBS Settlement Payout Amount

By signing a contract not to compete with each other and to restrict competition among themselves in providing health insurance and administrative services for health insurance, plaintiffs claim Settling Defendants broke antitrust statutes.

Denying all claims of impropriety, settling defendants say their behavior lowers healthcare costs and increases consumer access to treatment. 

The Court has not rendered a decision about right or wrong. Rather, to save the danger and expenses of future litigation, plaintiffs and settling defendants have decided on a settlement. Those who timely submitted the claim will be paid from the net settlement money individually. 

Many elements determine the individual’s settlement amount, including several legitimate claims, health insurance plan premiums paid, and whether your insurance is self-funded or completely covered. 

If the Court approves, the Settlement would finance $2.67 billion. Settling defendants will also agree to conduct business in the manner plaintiffs feel would boost the chances for competition in the health insurance market.

How do you check your BCBS Settlement Claim Status?

The BCBS class action settlement may verify the claim status to ascertain whether their claim is granted or not and if they will get the compensation or not in the next actions:

  • The BCBS subscriber settlement website may be accessed at https://www.bcbssettlement.com/.
  • You should then visit the “I Would Like To” page and select “Check my claim status.”
  • You should fill the provided box on the following page with your Claim Number or Unique ID.
  • Your BCBS settlement claim status is also shown after you click the Submit button. 

Who will receive the BCBS Settlement Payout?

The BCBS settlement agreement states that individuals fulfilling the following qualifying requirements are entitled to the payout:

  • During the class term, you have to have BCBS or an administrative services plan of health insurance coverage. 
  • While for individuals and insured groups, the class period is February 2008 and October 2020, the class period for the self-funded accounts is 01 Sep 2015 and 16 Oct 2020, if they have acquired Blue Shield health insurance or administrative services. You have a self-funded account or are from an insured group or individuals who bought the insurance plan or administrative services. 
  • Those who before the deadline, November 05, 2021, sent in their BCBS compensation claim form. 
  • The beneficiaries (minors), non-employees, and dependents—non-qualifying for the settlement. 
  • Those who, via the settlement exclusion form, have excluded themselves from the BCBS settlement. 

What happens if I do nothing at all for BCBS Settlement?

You remained a member of the Settlement Classes and bound by the Settlement if you did nothing. Nevertheless, you will not be paid if you have been entitled to participate in the Settlement funds. You stay in the Settlement Classes but you omit yourself. 

You cannot therefore litigate, keep suing, or participate in any other litigation against Settling Defendants that claims based on the facts and legal theories engaged in this case or any of the business practices the Settling Defendants adopt according to the Settlement Agreement.

It also implies that you will be legally bound and that every Court order will apply to you. The Settlement Agreement lists the Released Claims in great detail.

  1. I MADE A TIMELY CLAIM HOWEVER YOU SAID I PAID $0 IN PREMIUM IN YEARS 2009, 2010, AND 2011 WHICH IS UNTRUE. I REQUESTED FROM BLUE CROSS BLUE SHIELD THE AMOUNT I PAID DURING THOSE YEARS, THEY WERE NEVER ABLE TO PROVIDE THE INFORMATION CLAIMING THEY DIDNT KEEP RECORDS THAT FAR BACK. I SENT THIS INFORMATION TO THE CLAIMS ADMINISTRATOR ON MAR. 13, 2025 AT 3:39 PM ASKING WHAT SHOULD I DO NOW! I HAD NO RESPONSE AND NO ONE TO CALL. THIS LOOKS LIKE THE TYPICAL CLASS ACTION RESULT MILLIONS TO THE ATTORNEYS AND PENNIES TO THE INJURED!!!

    • Ron,i am in the lawsuit and very angry that it is taking so long to get the money to the people! The law firms and courts take their sweet ass time and people could die before they get their money! I filed my claim right after i got the post card years ago telling about it and it has been in review ever since.The law firm is very poor is keeping people updated!

  2. I received an email asking me to choose payment method for settlement claim back in February 2025. I have not received (nor heard) anything else about this claim since then.

    I generally do not participate in class action claims because of the shadiness of the payouts. Also, once you sign on, you negate the ability to file a personal claim and are forever forbidden to do so.
    However, with it being BCBS and the attorneys handling the class action, I felt that this was going to be handled properly. Didn’t expect the amount paid out to be much anyway. We will see.

  3. Shameful! I filed my claim immediately after receiving the postcard, chose a payment method back in February 2025 as requested, and there have been no communications since. It is now August 31, 2025 and still no payout. Announcements were made that payouts would begin before the end of 2024, then promised at the beginning of 2025. Still nothing. Many people have passed away since this class action began–is that money going to be divided? Is that money going to the families of the deceased? The amount of feet-dragging regarding this class action has been an abomination of justice. Even more disgusting and shameful are the bloated fees of all the lawyers vs. the pennies which we are still waiting for. People are tired of this dishonest and slimy handling of this case. I doubt this issue is ever going to go away like they are hoping. Remember what this lawsuit was about? Fairness, fair business practices? Does anybody know what fairness means?

  4. I filed long ago and got an update just today. The premium amount for 2 years says 0.
    Does that mean I’m not entitled to anything?

  5. As with many others’ comments, I submitted my claim on April 15, 2021 and then received a claim number. Either in December, 2024 or January, 2025, I (and all of us) received a notice asking for additional information. January 23, 2025 I submitted whatever was then further required and received notification that my response was submitted successfully.
    On November 5, 2024, I checked status on-line and the site said that “all claims are in review” and no payment date has been set. My belief is that all claims already had been reviewed and claimants notified whether or not they met the requirements to be included in the class. On August 18, 2025, I called to check status. Automated response was same as November 2024.
    On September 20, 2025, I called primarily to change my address. The outgoing message first notified me the same as previous inquiries on status. Address change procedure is cumbersome and gives me the feeling that it’s an effort to find a reason to cull claimants who have moved but haven’t notified case settlement people and whose USPS mail forwarding time has expired. So any notices, payments by check, etc., will be returned marked unable to deliver. BTW, in those cases or for deceased claimants, what happens to their payments? Who gets the dough? If an estate is in settlement, does it go there?
    This whole business reeks of slime and manipulation. The case has been settled. The court approved the total settlement amount. Claims and claimants have been approved. Why, now, are claims again being “reviewed” and why no explanation for the basis or reason(s) for this?

  6. Same boat. Got the e-mail in February 2025 asking what payment method. Still no word at all. I can guarantee the lawyers paid themselves in it though. Still showing in review and it’s coming up on a year. It’s ridiculous. The only ones that benefit from a class action lawsuit is the lawyers. They are crooks to the end. They don’t even bother to send other e-mails just giving an update as to when you can expect anything. It’s ridiculous.
