The Volino vs Progressive settlement final hearing was held on 05 March 2025, and the settlement got the final approval order on 07 March 2025 for the $48 million settlement fund. The Progressive Insurance paid the $48 million fund for the allegation of paying less to the New York drivers for the insurance.
The class members who were affected or received less than the actual insured cash value will receive compensation from the settlement. Class members who have not opted out by the deadline of 01 February 2025 and have done nothing can expect the payment soon.
Volino vs Progressive Settlement
The class action lawsuit was filed against Progressive Advanced Insurance, Progressive Casualty, Progressive Max, Progressive Max, saying they have paid less insured money to the drivers than the actual value of their vehicles.
The claim says the company has used third-party software that undervalued the vehicles’ pre-accident sales price. The plaintiffs allege that the software has some adjustments that impacted the negotiation, even when it is unnecessary to negotiate the online prices.
The plaintiffs alleged that the company had violated the New York General Business Law as it made adjustments to determine the total loss claims for the vehicle. The plaintiffs and defendant both agreed to resolve the class action lawsuit and process the payout to the class members from the $48 million fund.
The defendants disagree with any allegation and do not give their agreement for any wrongdoing. The settlement has passed the final approval stage, and now the class members who have not opted out will receive the payout.
Who are the class members?
The Volino vs Progressive class settlement has two classes that will be part of the settlement, such as:
- The New York residents who have made the first party claim on the insurance policy issued by the Progressive Group between July 28, 2025, and August 20, 2024, for the totaled vehicle. And they have received compensation on the basis of the Mitchell International Inc. report, and the actual value of the vehicle was reduced by the Projected Sold Adjustments.
- The New York residents who have made a third-party claim on an insurance policy from Progressive Group from July 28, 2018, till August 20, 2024, and got the compensation from any of the defendants for the covered vehicle loss, as the compensation was decided based on the Mitchell instance report. The actual money for the totaled vehicle was lowered to Projected Sold Adjustments when they compared the vehicle on the third-party software.
These are the two classes of the Volino vs Progressive settlement, however, the class members should remember, people who have filed the exclusion or objection form before or on 01 February 2025 will not be eligible for the compensation.
Payout Amount
The Progressive settlement fund is $48 million, and the fund is first used for the settlement administration cost, attorney fees and costs, service awards, and others. The remaining funds of the settlement will be used to process the payout to the class members, which, as per the administrator’s update, will be $31,200,000.
So, the class members will receive the payout from the $31,200,000 fund, and as per the administrator’s estimation on average payment, each class member may receive a payout up to $332 from the remaining settlement fund.
This is the estimation of the administrator, however, it can change if more class members file for opt-out claims or if the settlement administration expenses are greater than expected. The administrator will send a check to the class members based on their records with Progressive Insurance.
