The class members of Philips Respironics who filed their claims before the settlement deadline of 09 August 2024 await their settlement payout as the final approval of the settlement has already been granted.
The class members who were entitled to automatic benefits have already received their benefits, but the rest are still waiting. The Philips Respironics users waiting for the payout can check out the expected payment date as the settlement administrator has released a new update on the payout.
Respironics CPAP Settlement Payout Date
The Court granted the final approval for the Respironics CPAP settlement on 25 April 2025 and asked the eligible users to file the claim before the deadline of 09 August 2024 to receive the compensation from the $445 million settlement fund.
Under the settlement, the Philips defendants will compensate the class members with Device Return Awards and Device Payment Awards with additional Device Replacement Awards. The class members who have submitted the valid claim were earlier expecting the payment in September or November 2024, but the administrator has not processed the payment yet.
According to the latest update from the administrator, the class members who had filed the Accelerate Implementation Option, the AIO is still under review and they can expect the payment in spring 2025. The Device Return and Device Payment Awards along with Device Replacement awards will also be processed in the Spring 2025 ( April or May 2025).
However, the payer awards recipients will receive the respected awards early in February 2025 as the administrator is calculating the awards for claimants.
What’s the Respironics CPAP Settlement about?
The Philips CPAP lawsuit was started in 2021 over the BiPAP, CPAP, ventilators, and other devices that were sold or distributed across the US, which the company recalled. The plaintiffs say the devices release a certain noise-canceling foam that was used in the replaced devices that the company provided.
As per reports, the defendant recalled the devices in June 2021 under the Recall programs and replaced the devices in Sep 2021 with remanufactured BIPAPs, CPAPs, and ventilators to compensate the users or to resolve the foam issue.
The plaintiff says the foam had some particles that may cause problems to the people, according to the defendant they do not agree with any wrongdoings. However, they have agreed to compensate the users through the settlement for recalled devices only not for remanufactured devices.
The Philips Respironics users should know the class action settlement claim does not resolve the personal injury or medical monitoring claims as they are still going on.
Who meets the class member eligibility to receive the Respironics CPAP settlement?
According to the Respironics CPAP class action settlement, people who meet the following conditions will be entitled to receive the compensation if they have filed the claim:
- You either purchased, leased, paid, or rented the recalled device under the Recalling program.
- You are an individual or entity of the US ( including the District of Columbia and US territories) who has been reimbursed for the recalled device that was purchased, leased, and rented, which also includes self-funded employers, insurers, and third-party payers.
Exclusion:
- The defendant’s employees, directors, and officers are excluded from the Respironics CPAP settlement;
- The judge associated with the class action, mediator, and Special Masters assigned to the class action are excluded,
- People who have filed the settlement exclusion form timely from the Respironics class action settlement will be excluded from the compensation.
How much can you receive through the Respironics CPAP Settlement?
As we have mentioned, the Philips Defendants have agreed to pay at least $445 million to resolve the case and compensate the users through the following awards:
- Device Payment Awards,
- Device Return Awards
- Device Replacement Awards
- Payer Awards
But before paying the compensation to the users, the settlement fund will be utilized to manage the litigation cost, settlement administration cost, attorney fees and costs, and service awards to the class representative.
The claimants can check the Respironics CPAP settlement payouts based on the awards they qualify for, here’s the payout of each benefit:
- Device Payment Awards:
- The Philips Respironics users will be entitled to the Device Payment awards based on each recalled device that they have leased, purchased, or rented.
- The award payout depends on the recalling device model, hence the payment may vary for each user, for instance, the System One 50 series ASV4 device will offer a $469.14 payout, V30 auto offers $67.12, etc.
- The claimants can check Device Payment Awards based on the model on the settlement website.
- Device Return Awards:
- The claimants get the Device Return Awards for each recalled device they returned to the company before 09 August 2024.
- According to the settlement agreement, the claimants can receive $100 under the Device return awards.
- Device Replacement Awards:
- The users who have replaced the recalled device can receive compensation for the money they spent on replacing the device to the company on or after 14 June 2021 and before 07 Sep 2021.
- Payer Awards:
- The third-party insurers may qualify for the payer awards and will be settled from the $34 million settlement fund.
- The payout under the payer awards will be based on the eligible payer’s market share and number of lives insured by the Eligible payers in the US and the premium amount during the period 2021 and 2022.

As it’s been quite a long time since the Respironics Settlement, it’s possible that many class members may have changed their contact information or want to change their payment method. In that case, the class members who filed the claim can contact the settlement administrator and choose their payment option by utilizing their Confirmation form.

The payment options available for the Respironics CPAP settlement are Virtual Mastercard, Zelle, or paper check, whereas the Payers can receive their awards through ACH payment or the physical check.
The Respironics CPAP settlement claimants can expect the payment in Spring 2025 except the payer awards eligible people who will receive their payout in February 2025.
