MyChart Class Action Lawsuit Payout

The class action lawsuit was filed against the BJC Health System d/b/a BJC Healthcare over the patients’ privacy issues who use the BJC MyChart patient portal. The federal court granted preliminary approval for the MyChart class action settlement of $5.5 million in May 2025. 

Under the settlement, class members who have a valid claim form can receive the cash payment of $35 based on the equal distribution of the fund. However, if the fund is not enough to cover the compensation for all the claimants, the settlement fund can be increased to $9,25 million.

Excluded:

• The parents, subsidiaries, officers, or BJC affiliates or employees or officers are excluded from the settlement. 
• The judge or judicial staff related to the settlement and their immediate family members cannot file the claim. 

How will the settlement fund be distributed?

According to the settlement agreement, the class members will receive the payout from the net settlement fund, which is determined from the settlement fund of $5.5 million after the following expenses are paid:

• Attorney Fees of $3 million
• $15000 to each class representative 
• Settlement Administration expenses

The court will approve the attorney fees, class representative award, or other expenses from the settlement fund during the final approval, so the amount for the payout can be changed. 

If the number of claims filed exceeds the settlement fund, even after adding more, the fund will be increased to $9.25 million, and the payout for the individuals can be reduced from $35.

When can you expect the BJC privacy settlement payout?

The final approval hearing for the BJC MyChart Privacy class action settlement was set on 16 October 2025 at 1:30 PM. The court will make a decision on the fairness of the settlement fund distribution, so if the court grants approval, the administrator will begin its work of distribution. 

According to the class action, the typical timeline is that you can expect your payout in 90 to 180 days after the final approval if no one appeals against the court decision.
