A lawsuit was filed against the Hatch Baby alleging violations of federal and state consumer law on 10 Oct 2024. On 10 Oct 2024, Tracy Bott from New York sued Hatch Baby in NY federal court alleging that Hatch Baby Inc. has violated consumer laws as they failed to inform their customers about the defective power adapters of the popular sleep devices. The lawsuit came after Hatch recalled its defective adapter in July 2024. 

The lawsuit claims the power adapter of Hatch Baby First Generation Sound machines is unsafe as it can cause shock hazards. According to the lawsuit, the plaintiff claims the company failed to notify the customers about the product at the time of purchase and that the sound machines produce low noise that puts babies to sleep which can cause issues. 

The company has also received two reports from customers where they have faced minor electrical shocks. The class members who bought the products were exposed to electrical shock which could lead to dangerous issues. Though Hatch Baby has voluntarily recalled the products, it has failed to conduct the appropriate actions.

As we have mentioned earlier, the Hatch Baby recalled the power adapters of the first generation sound machine in July 2024 based on the complaints. The California-based sleep product manufacturer has recalled around 1 million power adapters sold nationwide.

The Consumer Product Safety Commission says the company has received around 19 reports claiming the adapter has come off and creating an issue. The company has urged its customers to not use the recalled adapter model number CAP 05-050100 U and contact the company for the replacement of the adapter. 

The company has instructed consumers to unplug and cut the cord of the power adapters before uploading the photo of the adapter’s model number on the official Hatch Baby Recall website. The recalled adapters include the power adapters of Rest’s first-generation devices that were sold between 2019 and 2022. The company has ensured that 2nd generation devices are not part of this recall. 

Who will be the Hatch Baby Lawsuit Class members?

The Hatch Recall lawsuit covers all the United States citizens who have bought the Hatch Rest 1st Generation Sleep Machine during the class period, January 2019 and May 2024 with a power adapter of model number CAP 05-050100 U. 

According to the company recall website, the company has already sent an email to the eligible customers about the recalling of the Rest 1st generation with a link to the replacement form. The customers should know the recall is for power adapters issued by a Chinese company Jiangsu Chenyang Electron Co. 

The company is offering a free replacement of the power cord of the recalled adapter for the impacted customers. The customers can identify the recalled adapters based on their model number and date code on the adapter which is not present in the recalled adapter. 

Hatch Baby Lawsuit Compensation

As per the lawsuit, the plaintiff has requested statutory and monetary compensation for all the impacted customers. The lawsuit states that the shock hazard in the product was avoidable as many other companies have sound machines with no such shock hazard, still, the defendant failed to avoid such an issue causing problems to the customers. 

So, the defendants should pay $50 per transaction for damages and three times the damages they have suffered. The compensation for deceptive practices that are subject to $500 for each transaction that happens due to false advertising and unlawful actions.  

When will the customers receive the replaced Hatch Baby power adapter?

The customers who have filed the replacement form for the replacement of the power adapter will receive the replaced cord in some weeks. The company has updated they have faced a delay in the shipment of the replaced power cords of the recalled adapter. 

According to the latest updates, the impacted customers can expect the delivery of the power cord in 4 weeks or as quickly as possible. The company is working on replacing the recalled adapters as soon as possible as part of its commitment to Consumer Safety and Incident Prevention.
