The settlement resulted from a class action lawsuit, which was filed against the Kaiser Foundation Health Plan Inc. with allegations of violating the Telephone Consumer Protection Act and Florida’s Telephone Solicitation Act by sending promotional text messages even after opting-out with ‘STOP’ reply.

The court has preliminary approved this settlement, and now the claim form filing is taking place. The due date to file it is February 12, 2026, in order to get a portion from the $10.5M fund, it is mandatory that you submit your claim form online or offline by the due date by providing all the details accurately. 

Who is eligible for the Kaiser TCPA & FTSA Settlement?

In order to apply for the Kaiser TCPA FTSA settlement, it is mandatory that you meet the following requirements:

  • You are a US citizen and reside on any territory of the country.
  • You received more than one text message from Kaiser Foundation Health Plan Inc. between January 21, 2021, and August 20, 2025.
  • You have opted-out to get promotional text messages by replying with ‘Stop’ or similar message. 
  • If you belong to Florida, you may qualify under an additional category if you have received text  messages at least 15 days after opting out.

Additionally, you have received a notice about the settlement from the settlement administrator via email or postmark, which carries Unique ID and PIN.

How much will be received from the Kaiser TCPA & FTSA Settlement?

The amount you receive from the Kaiser TCPA & FTSA class action settlement depends on the number of text messages you received.  Each text message entitles an individual to $75. For example, if you received a total of 10 text messages, you would receive $750.

The $75 amount is not fixed; it depends on how many people submit claim forms. If the number of claimants is higher than expected, the amount per message could shrink to $50, and if the number of claimants is lower than expected, the amount could increase to $100.

When to expect the Kaiser Permanente Text Message Settlement payout?

The payout for the Kaiser Permanente Text Message Settlement will be received several months after final approval by the court. A hearing was scheduled for January 28, 2026, but final approval has not yet been granted. It is expected that final approval will be received by the end of February 2026.

It is anticipated that the Kaiser TCPA and FTSA Settlement payout will be distributed within three months of receiving final approval from the court, provided there are no appeals. In the event of appeals, claimants may have to wait six to eight months for the payout.
